Sworn Spanish Translation of Gibraltar Documents: 10 Your Essential Guide

Sworn Spanish translation of Gibraltar documents is often required. Gibraltar’s close geographical, economic and legal connections with Spain mean that official document translation is often essential for individuals, businesses and legal professionals dealing with Spanish authorities.

Whether you are a Gibraltar resident, a British national with interests in Spain, a company operating across the border or a law firm handling cross-border matters, you may need a sworn Spanish translation of Gibraltar-issued documents for a variety of legal, administrative and commercial procedures.

In these circumstances, choosing an experienced sworn Spanish translator is particularly important. Documents issued in Gibraltar are generally written in English, whereas Spanish public authorities, courts, notaries and other institutions may require an official Spanish translation before accepting them.

In this article, I explain when you may need a sworn Spanish translation, which documents are commonly translated and how the recent UK-EU agreement concerning Gibraltar fits into this changing legal and administrative landscape.

Gibraltar, Spain and the new UK-EU Treaty

The relationship between Gibraltar and Spain has entered a new chapter following the conclusion of the UK-EU Agreement in respect of Gibraltar.

After years of negotiations, the United Kingdom and the European Union signed the agreement in Brussels on 14 July 2026. It has been provisionally applied since 15 July 2026, pending its formal entry into force following the completion of the relevant ratification procedures.

The agreement establishes a new framework for relations between Gibraltar and the EU, with arrangements designed to facilitate the movement of people and goods across the Gibraltar-Spain border. It provides for the removal of physical barriers at the border, the application of relevant Schengen border-control arrangements and a customs union between Gibraltar and the EU.

Importantly, Gibraltar is not formally joining the Schengen Area, and the agreement does not resolve or alter the respective positions on sovereignty over the territory.

These developments are particularly relevant to individuals and businesses with interests on both sides of the border, including frontier workers, companies, property owners and legal professionals.

However, closer cooperation and more streamlined border arrangements do not eliminate the need for official Spanish translations. Whenever a document issued in Gibraltar or another English-speaking jurisdiction has to be submitted to a Spanish authority, a sworn translation into Spanish may still be required.

When Do You Need a Sworn Spanish Translation of Gibraltar Documents?

You may need a sworn Spanish translation whenever an official document issued in Gibraltar has to be presented to a Spanish public authority or institution and the receiving body requires an officially certified translation into Spanish.

This requirement can arise in many different circumstances. It is not limited to immigration applications or personal documents: it also affects property transactions, inheritance proceedings, company registrations, employment matters and legal disputes.

For example, a Gibraltar birth certificate may need to be translated for registration with a Spanish Civil Registry. A certificate of naturalisation may be required in connection with a nationality or administrative procedure. Similarly, a Gibraltar company’s certificate of incorporation, Articles of Association or annual accounts may need to be translated for submission to a Spanish notary, commercial registry, bank or business partner.

A sworn Spanish translation may also be required when:

  • Applying for Spanish nationality or dealing with immigration matters: Documents proving identity, civil status, nationality or family relationships may need to be submitted in Spanish.
  • Registering personal or family circumstances in Spain: Births, marriages, divorces and other civil status events may involve foreign certificates and court documents.
  • Buying, selling or inheriting property in Spain: Spanish notaries, Land Registries and legal professionals may request official translations of deeds, certificates, inheritance documents and powers of attorney.
  • Setting up or administering a company in Spain: Gibraltar corporate documents may be needed for company registration, corporate transactions, banking or due diligence.
  • Working or establishing professional activities in Spain: Employment contracts, professional qualifications and other supporting documents may need to be translated.
  • Taking part in legal proceedings: Court judgments, witness statements, affidavits and other legal documents may require sworn translation for use before Spanish courts or other authorities.

What exactly is a sworn Spanish translation?

In Spain, a sworn translation (traducción jurada) is an official translation produced by a translator appointed by the Spanish Ministry of Foreign Affairs, European Union and Cooperation (MAEC).

Unlike an ordinary translation, it includes the sworn Spanish translator’s official certification and signature, confirming that the translation is a faithful and accurate rendering of the original document.

Sworn translations issued by MAEC-appointed translators are officially recognised in Spain and are generally accepted by Spanish public authorities and institutions, subject to any specific requirements applicable to the procedure concerned.

As a sworn English-Spanish translator appointed by the Spanish Ministry of Foreign Affairs, I provide official translations of English-language documents for use in Spain.

It is worth remembering that the requirement for a sworn translation depends on the receiving authority and the purpose for which the document is being submitted. Not every document written in English automatically needs to be translated, and it is always advisable to check the requirements of the relevant Spanish institution beforehand.

What Gibraltar Documents May Need a Sworn Spanish Translation?

The documentation required will depend on the particular procedure. Below are some of the most common categories of documents that individuals and businesses may need to have translated.

1. Personal and Civil Status Documents

Individuals with personal, family or administrative matters in Spain may need sworn translations of:

  • Birth certificates.
  • Marriage certificates.
  • Death certificates.
  • Divorce decrees and court orders.
  • Certificates of civil status.
  • Certificates of residence.
  • Certificates of naturalisation.
  • Passports and other official identity documents, where translation is required.
  • Powers of attorney.
  • Wills and inheritance-related documents.

These translations may be required for Civil Registry procedures, marriage registration, inheritance proceedings, nationality applications and other administrative or legal matters.

2. Property and Conveyancing Documents

Gibraltar residents and property owners with interests in Spain may need sworn translations of:

  • Property deeds and title documents.
  • Sale and purchase agreements.
  • Mortgage documentation.
  • Powers of attorney relating to property transactions.
  • Land Registry documents.
  • Inheritance and succession documents.
  • Property-related certificates.

These documents are frequently required by Spanish notaries, solicitors, registries and other professionals involved in property transactions.

3. Corporate and Commercial Documentation

Businesses operating between Gibraltar, Spain and the UK may also require official translations for corporate, financial and commercial purposes.

Examples include:

  • Certificates of incorporation.
  • Certificates of good standing.
  • Memorandum and Articles of Association.
  • Company extracts and registry documents.
  • Board resolutions and shareholders’ resolutions.
  • Powers of attorney.
  • Commercial agreements and contracts.
  • Annual accounts and financial statements.
  • Auditors’ reports.
  • Certificates of tax residence.

This type of documentation is particularly relevant to cross-border business operations, company registrations, investments, corporate restructuring and transactions involving Spanish companies.

4. Employment and Professional Documents

For employment, professional recognition and administrative procedures in Spain, the following documents may also need translating:

  • Employment contracts.
  • Employer’s certificates.
  • Payslips.
  • Professional qualifications.
  • University degrees and academic transcripts.
  • Professional registration certificates.
  • References and employment records.

Frontier workers and individuals moving between Gibraltar and Spain may encounter situations in which official translations are needed to support employment, social security or other administrative procedures.

Legal proceedings involving Gibraltar and Spain can generate a considerable amount of documentation requiring specialist legal translation.

This may include:

  • Court judgments and orders.
  • Divorce and family law proceedings.
  • Witness statements and affidavits.
  • Litigation documents.
  • Notarial deeds.
  • Trust deeds and related documentation.
  • Legal opinions and certificates.
  • Contracts and agreements.

Legal terminology must be translated accurately, taking into account the differences between the legal systems and the terminology used in England and Wales, Gibraltar and Spain.

Do Gibraltar Documents Need an Apostille?

A further point to consider is the distinction between sworn translation and legalisation.

Some official documents issued in Gibraltar may need an Apostille under the Hague Apostille Convention before they can be used in Spain. Whether an Apostille is required depends on the nature of the document, the applicable international arrangements and the requirements of the Spanish authority receiving it.

An Apostille authenticates the origin of a public document; it does not certify the accuracy of its translation.

Where an Apostille is required, it should also be included in the material submitted for sworn translation, so that the entire document, including the Apostille, is translated.

It is therefore advisable to check the legalisation requirements before commissioning a translation, particularly when dealing with civil status documents, certificates of naturalisation, powers of attorney, court documents and corporate records.

Please note that I provide sworn translations but do not arrange Apostilles or other legalisation procedures.
